$5,500,000 settlement structured for a 6 year old who sustained brain damage during her birth causing cerebral palsy, mental retardation and spastic quadriplegia.
During a 48 hour labor, managed by nurse-midwives, the baby suffered severe distress. During the final hour of labor, the nurses and midwives misinterpreted the fetal monitoring strips which showed significant signs of lack of oxygen to the baby’s brain. After the delivery, still not realizing the significant injury to the baby, the nurse placed the baby on the mother’s stomach for “bonding”. It wasn’t until a family member shouted that the baby wasn’t breathing, that they rushed her to the neonatal intensive care unit.
The baby survived the birth, but was significantly damaged. She had cerebral palsy, mental retardation and spastic quadriplegia. The settlement was structured to provide lifetime care for the child with the best possible equipment, aides and medical care available.
