Landmark Products Liability Decision

In a landmark decision on products liability, the New York County Supreme Court secured a plaintiff's rights to present evidence supporting the need for manufacturers to correct or instruct consumers about serious safety defects in their products after the sale.

{mosimage}"The legal significance is that it is the first time a New York State Appellate Court cited the Braniff Airways case with approval for the proposition that a manufacturer may still be responsible for retrofitting a safety device to their product if they become aware of a dangerous defect after the product is sold," says Richard Gurfein, a leading products liability attorney serving in the case, "as long as they don't have to invent a solution to fix it."
